Senate Republicans are signalling a tentative willingness to let Elena Kagan pass into the highest court in the land, since they can find very little to object to. Or very little of any shred of opinion that can’t be argued away by friends and advocates. They promise to ask “tough questions” – it is hoped they don’t taint their lines of inquiry too much by pandering to the base.
